Se ordenó inaplicar el Art. 1º del Decreto 1382 de 2000 por ser manifiestamente contrario a las disposiciones constitucionales.
En consecuencia, se dirimió el conflicto de competencias suscitado entre el Tribunal Administrativo de Cundinamarca y el Juzgado Quinto Civil Municipal de Bogotá, en cuanto a la acción de tutela incoada por el ciudadano de la referencia contra la Fiscalía General de la Nación y otros, en el sentido de que la competencia para conocer de ella corresponderá al mencionado Tribunal, al cual se remitió el expediente respectivo.
